Great long service leave win for Olivia
Published on: Mar 21 2017
Union member Olivia, recently contacted the SDA while in discussions with her employer; a national chemist chain. Olivia’s long term partner had been offered a high paying job abroad. As her partner is the breadwinner of the family, and Olivia was only working part-time, she resigned from her position.
Olivia had worked for the company for over 5 years and was entitled to claim for long service leave due to ‘domestic or other pressing necessity’ (NSW Long Service Leave Act s 4(2)(a)(iii)). The company felt as Olivia was resigning she would no longer be entitled to long service leave.
With the help of the SDA, Olivia was paid out $3,282 (5.119 weeks’ pay).
This is a great win for Olivia. Good luck abroad!
